To determine the levels of compliance among State institutions covered by the Transparency and Access to Public Information Law, Fundamedios presented 40 requests for access to information addressed to the Presidency, Vice-presidency and the various Ministries and State Secretariats.
(Fundamedios/IFEX) – Since 18 May 2004, Ecuador has enforced the Transparency and Access to Public Information Law (LOTAIP), which establishes the parameters within which citizens can exercise their right to access information, as well as the authorities’ obligations regarding the transparency of public administration.
To determine the levels of compliance among State institutions covered by the LOTAIP, Fundamedios presented 40 requests for access to information addressed to the Presidency, Vice-presidency and the various Ministries and State Secretariats. The petition requested a detailed list of the media through which each entity advertised their programs, plans and projects throughout 2012. A follow-up of the petitions determined that 26 of the 40 institutions involved responded to the request. Of those 26, only 14 delivered all the information requested.
According to Article 9 of the LOTAIP, institutions must respond to this kind of request within 10 days. Of the 26 institutions that delivered the information requested by Fundamedios, 10 complied with the deadline established by this regulation. We should draw attention to the fact that the Presidency of the Republic and the National Communication Secretariat were among those institutions that declared they did not have the information requested.
