(NDIMA/IFEX) – On 22 December 1998 Cabinet Minister Nicholas Biwott was
granted court orders restraining opposition Member of Parliament Njehu
Gatabaki from publishing articles linking him to the murder of former
Foreign Affairs Minister Robert Ouko, who was killed in February 1990.
Lawyer Patrick Lumumba told Justice Kasanga Mulwa that Gatabaki had defamed
his client in the 13 December edition of “Finance” magazine, a weekly
publication of Finance Institute Limited distributed by the Finance Journal
Company.
He said that taken in their natural context, the words in the article
insinuated that Biwott had killed the late Foreign Affairs Minister and
British tourist Julie Ward. He said the article claimed that the Minister
ordered others to rape the tourist and also organised the assassination of
many other Kenyans. He asked the court to stop Gatabaki and his agents from
publishing any further articles on the subject.
Lumumba told the court that Gatabaki had been served with the orders but did
not enter appearance. The case was fixed for 7 February 1999.
