(NDIMA/IFEX) – On 16 July 1998, the High Court in Kakamega (in western
Kenya)
ordered Police Commissioner Duncan Wachira to impound editions of “Finance”
magazine, which is published by Opposition politician Njehu Gatabaki.
Resident judge Barabara Tanui directed that the Commissioner or his
representatives should keep in police custody any issue or editions of
“Finance” dated 28 June 1998, as well as future publications touching on
businessman and former aide to President Moi, Joshua Kulei.
Tanui said “Finance” should not be circulated in the market until a civil
case pending before the court was heard and determined. He also restrained
the Finance Institute Limited, its publisher Njehu Gatabaki and editors from
publishing statements touching on Kulei which may in any way be prejudicial,
defamatory or libellous of his character. Tanui
issued the orders when he granted the application of Kulei’s advocate.
