(ARTICLE 19/IFEX) – During the week of 18 September 2000, the Press and Broadcasting Codes of Conduct in Kosovo were approved and issued. The laws had been criticised by ARTICLE 19, since they were both drafted and are to be implemented by the temporary media commissioner, thus breaching the basic principle under international law that decisions on alleged violations of the law must be made by a body independent of government.
The Media Appeals Board appears to agree with this view, having referred a fine imposed on newspaper “Dita” by the commissioner back to him on the basis that “the sanction had not satisfied the procedural guarantees required by internationally recognised human rights and the applicable law in Kosovo”.
