In spite of repeated promises made to IPYS and Reporters sans
frontieres (RSF) as well as to Carlos Rivera, the lawyer for
imprisoned journalist Jesus Alfonso Castiglione Mendoza, Dr
Marcos Ibazeta, the President of the Superior Court, still has
not followed through with his offer to transfer the case files of
Castiglione from the Superior Court to the State Prosecutor.
At the end of May 1996, Ibazeta stated to IPYS and RSF that the
process would take no more than three weeks. Nevertheless, even
though the Penal Code does not stipulate that case files are
required to be passed on within a specified time frame, legal
experts claim that such a transfer of case files should not take
more than two weeks.
It is estimated that once the case files of Castiglione are
finally transferred to the State Prosecutor they will be held up
for approximately eight months before the Supreme Court is able
to render a verdict, during which time Castiglione will remain
imprisoned.
