(FNJ/IFEX) – Top leaders of eight political parties signed the Interim Constitution on 16 December 2006 at the prime minister’s official residence at Baluwatar, Kathmandu.
The Interim Constitution, under its preamble, has expressed full commitment to complete press freedom along with competitive multi-party democracy, civil liberties, fundamental rights, human rights, adult franchise, periodic election, independent judiciary and rule of law. The Interim constitution has guaranteed freedom of expression of every citizen under Fundamental Rights in Part 3 Article 12(3) (A).
Similarly, the Interim Constitution under Article 15 has guaranteed the following publication, broadcasting and printing rights:
– Publication and broadcasting of any news, editorial, article, features or any other reading and audio-visual materials through the electronic, broadcast, print and any other media will not be censored.
– No radio, television, online or any other digital or electronic press or other media will be closed, seized or have its registration cancelled for broadcasting or printing any audio, audio-visual or any other material.
– No newspaper, magazine or printing press will be closed, seized or have its registration cancelled for printing or publishing any news, article, editorial, features or other reading materials.
– Except as provided by law, no printing press, electronic broadcasting and telephone, along with other communication equipment, shall be obstructed.
The Interim Constitution will be promulgated once the management and monitoring of arms and armies commence in accordance with the 12 November Comprehensive National Peace Treaty and the 8 December Agreement on Monitoring of the Management of Arms and Armies.
