(NDIMA/IFEX) – On 31 March 1998 the High Court awarded Abraham Kipsang
Kiptanui, former comptroller of State House, over 250,000 $US in damages for
libel caused by an article published in “Target” magazine. Kiptanui had sued
“Target” over an article published in the 16-31 January 1996 issue entitled
“3 billion shilling deal off.” According to Kiptanui, several individuals
working for or otherwise connected to the magazine were guilty of falsely
and maliciously writing, printing and publishing or causing to be published
a defamatory article which portrayed him as unworthy of holding a high
public office. In his judgment, Justice J. C. Juma said that the apology
offered by “Target” meant that they were admitting the defamation. As the
judge put it: “This removes the apology and resurrects the defamation.”
