(IPYS/IFEX) – The Institute for the Defence of Consumers and Intellectual
Property (INDECOPI) has prohibited the distribution and marketing of the
publication known as “Repúdica” as a precautionary measure to protect
intellectual property. “Repúdica” has imitated the logo and format of the
daily “La República”, and has been disparaging independent journalists and
opponents of the government (see previous IFEX alerts).
**Updates IFEX alerts of 8 June and 1 June 1999; for background on previous
cases against “La República” editor Gustavo Mohme, see IFEX alerts of 28
May, 21 May, 17 May, 20 April and 8 April 1999 and 2 December 1998**
The prohibition was the decision of the Copyright Office of INDECOPI, in
accordance with Articles 240 and 241 of the Law of Industrial Property. The
prohibition order was signed by Luis Alonso García Muñoz-Nájar, director of
the Copyright Office, which has been investigating accusations against the
editors of “Repúdica” since it was published on 31 May, using the same
graphic design as “La República”.
INDECOPI’s decision was communicated to the Peruvian National Federation of
Vendors of Newspapers, Magazines and Lotteries so that they could in turn
take appropriate measures. In addition, they are preparing to inform retail
outlets that sell newspapers of the new measures, in order to put a stop to
the distribution of the publication.
INDECOPI has asked police to aid them in ensuring that their order is
enforced and to provide any necessary help in preventing any incidents.
