**Updates IFEX alert dated 18 July 1995**
The Third Criminal Chamber of the Superior Court of Lambayeque
repealed an order issued to detain journalists David Passapera
Portilla, Mauro Vasquez Gonzales and Carlos Idrogo Bravo, of
Radio Chota and the daily “La Republica”. The Court instead
ordered the three journalists to appear before a judge.
The order to detain the journalists was issued by an examining
court (the Segundo Juzgado Mixto de Instruccion) of the province
of Chota, department of Cajamarca, in July. The journalists were
accused of disturbing public order (see IFEX alert).
The examining magistrate (juez instructor provisional) of Chota,
Judge Oscar Perez Sanchez, issued a statement in which he denies
having ordered the journalists detained. OFIP notes, however,
that Judge Perez Sanchez did charge the journalists with
disturbing public order as an offence against the state. The
journalists were charged in connection with comments they made
during a municipal gathering. They were masters of ceremony of
the event, and read statements by organizations and unions
expressing solidarity with the mayor of Chota, who was at the
centre of a judicial inquiry into his conduct.
David Passapera Portilla, detained on 22 June (correction to date
of detention in original alert), was released on 21 July.
